Sean “Diddy” Combs, the music mogul facing serious federal charges, has officially abandoned his attempt to secure release on bail. This decision follows multiple court denials and marks a pivotal moment in the ongoing legal saga surrounding the hip-hop icon.
Diddy Withdraws Bail Appeal
On Friday, Combs’ legal team informed the 2nd US Circuit Court of Appeals that he was withdrawing his appeal. In a court filing, his attorney stated, “Mr. Combs does not seek to appeal the district court’s denial of his renewed motion and hereby moves to dismiss the appeal voluntarily.”
The filing included a signed statement from Combs himself, affirming his understanding of the consequences of this decision. “Mr. Combs hereby states that (a) counsel has explained the effect of voluntary dismissal of the appeal; (b) he understands counsel’s explanation, and (c) he desires to withdraw and voluntarily dismiss the appeal,” it read.
Why Combs Remains in Custody
Since his arrest in September, Diddy has been held at the Metropolitan Detention Center (MDC) in Brooklyn. Federal prosecutors allege he engaged in sex trafficking, forced labor, and other serious crimes as part of a racketeering enterprise spanning over a decade. Combs pleaded not guilty to all charges, but his requests for bail have been repeatedly denied.
Last month, Judge Arun Subramanian ruled against his release, stating there was “clear and convincing evidence” of potential danger to the community and a “serious risk of witness tampering.” The decision referenced allegations that Combs had contacted witnesses and violated jailhouse rules by using other inmates’ phone access codes.
Defense Efforts for Bail and Home Confinement
Combs had proposed strict conditions for home confinement in a luxurious Upper East Side apartment, including 24/7 private security and limited communication. However, prosecutors argued that he “cannot be trusted” to adhere to the terms of a pretrial release. Subramanian ultimately sided with the prosecution, marking the fourth denial of Combs’ bail request.
Access to Legal Resources in Custody
Despite the denied bail, Combs has been granted access to a laptop loaded with evidence about his case. Judge Subramanian ordered MDC-Brooklyn to provide Combs with access to the laptop seven days a week. The court clarified that the device’s sole purpose is to review discovery materials. “The purpose of the Discovery Laptop is to review discovery, not to take or store notes,” the order stated.
